Terms of Use
These Terms are drafted for a cautious Adoracle soft launch: a free local-first app, optional location/photo verification, Owlzi NFC interaction, and clearly labeled partner/affiliate quests.
1. Operator and relationship to Crystal Sky
Adoracle is a digital exploration and photo quest project operated by Jake Austin Hyvonen, an Austrian sole proprietor / Einzelunternehmen using the brands Crystal Sky and Adoracle.
Crystal Sky may sell physical art, jewelry, gemstone sphere objects, and Owlzi companions. Adoracle is the digital service/app. Unless explicitly stated otherwise, these Terms apply only to Adoracle and not to separate Crystal Sky jewelry purchases, which may have separate shop terms.
2. Description of the service
Adoracle helps users explore their surroundings, receive vague ritual prompts or fortunes, complete location/photo quests, record photos and notes, and optionally interact with physical Owlzi NFC companions. The app may include points, streaks, quest calendars, maps, partner quests, and optional verification features.
Adoracle is intended for creative exploration, reflection, and personal documentation. It is not navigation for safety-critical use, not professional advice, and not a guarantee that a location is safe, accessible, open, lawful to enter, or suitable for photography.
3. Eligibility and age
Adoracle is intended for users aged 16 or older. Users under 16 may not use the app or create an account unless a legally sufficient parental/guardian consent flow has been implemented and the terms shown to that user explicitly allow it.
By using Adoracle, you confirm that you can lawfully use the service in your country and that you will comply with these Terms and applicable law.
4. Outdoor, location, and personal safety
You are responsible for your own safety and judgment when using Adoracle. Do not use the app while driving, cycling in traffic, operating machinery, crossing roads, climbing, entering water, entering construction sites, or doing anything that requires full attention.
Adoracle quests do not grant permission to enter private property, restricted areas, paid venues, protected areas, closed parks, transit areas, museums, shops, workplaces, residential buildings, rooftops, tunnels, tracks, or any place where access is not clearly lawful. Obey traffic rules, signage, park rules, photography rules, opening hours, and instructions from authorities or property owners.
Skip any quest that feels unsafe, illegal, intrusive, disrespectful, physically unsuitable, or inappropriate for the weather, your health, accessibility needs, or the surrounding situation.
5. Photo and conduct rules
You are responsible for photos, notes, captions, and other content you create or submit. You must have the right to create, store, upload, verify, or share that content.
- Do not photograph people where this would violate privacy, dignity, house rules, or the law.
- Do not upload or share photos of children, strangers, private interiors, license plates, documents, screens, medical settings, shelters, schools, or sensitive situations unless you have a lawful basis and appropriate consent.
- Do not submit content that is illegal, discriminatory, hateful, harassing, sexually exploitative, violent, self-harm-promoting, deceptive, or invasive of privacy.
- Do not use Adoracle to stalk, surveil, harass, map, identify, or target people.
Adoracle may reject, remove, or disregard content or verification attempts that appear unsafe, fraudulent, irrelevant, unlawful, abusive, privacy-invasive, or technically suspicious.
6. Local data and backups
Adoracle stores photo bytes locally on your device by default while family, Journal, and CertifiCute metadata may synchronize to the authenticated backend. You are responsible for backing up device-local data you want to keep. Deleting the app, clearing browser storage, changing devices, or browser/app cleanup may delete local Adoracle data.
7. Location and AI verification
Some quests may require a location check, a photo, or optional AI verification. Verification results may be wrong. Adoracle may award or withhold points based on automated checks, anti-cheat checks, or review. Points, streaks, badges, and quest status are entertainment/game mechanics and have no cash value unless a separate written offer explicitly says otherwise.
Do not spoof GPS, submit old or unrelated photos as new, manipulate metadata, automate submissions, reverse engineer verification, create fake accounts, abuse referral/partner codes, or otherwise cheat the system.
8. Owlzi NFC companion and fortunes
Owlzi may contain or link to passive NFC tags or QR/deep links that open Adoracle, a quest, a fortune, or a prompt. Owlzi fortunes are for entertainment, reflection, and creative ritual only. They are not medical, psychological, legal, financial, spiritual, safety, or emergency advice.
Physical Owlzi objects may contain small parts, gemstones, magnets, NFC tags, adhesives, or printed components depending on the model. Unless separately stated and certified, Owlzi is an art/ritual object and not a toy for children.
9. Partner quests, affiliate rewards, and sponsored content
Adoracle may show partner quests, sponsored quests, affiliate links, reward codes, or local business offers. These will be labeled using terms such as “Sponsored Quest,” “Partner Reward,” “Affiliate Link,” or similar wording.
If Adoracle receives money, commission, free products, free services, discounts, or another economic benefit from a partner, this should be disclosed near the relevant quest, link, or reward. Partner rewards may be limited, changed, suspended, or withdrawn. The partner business is responsible for its own products, services, opening hours, access rules, safety rules, prices, and redemption conditions.
Unless clearly stated, Adoracle is not the seller of partner goods or services. Any purchase from a partner is between you and that partner.
10. Accounts, suspension, and deletion
The public site is usable without an account. The optional family portal and cloud sync require Google sign-in. You are responsible for your Google account security, accurate information where required, and actions performed through your linked family identity.
Family owners control invitations, account roles, and removals; editors may manage profiles; viewers have read-only profile access. A CertifiCute redemption is a personal promise between family members, not a payment instrument, voucher sold by Adoracle, guaranteed reservation, emergency service, or legally supervised performance. Family members remain responsible for agreeing practical details, safety, consent, availability, cancellation, and fulfillment.
Adoracle may suspend or delete accounts, quests, points, rewards, or submissions if needed to protect users, prevent abuse or fraud, comply with law, enforce these Terms, fix technical issues, or protect partners and the service. Where reasonable, Adoracle will consider context and proportionality.
You may request deletion of account/server-side data through the app or the deletion page. Local-only data may need to be deleted on your own device.
11. Free beta, paid features, and digital service rules
The intended soft launch is free. If paid features, subscriptions, in-app purchases, paid downloads, premium quests, or paid digital services are introduced, the price, main features, duration, renewal/cancellation terms, compatibility, payment provider, tax/VAT treatment, and withdrawal/cancellation rights must be shown before purchase.
For consumer digital services in Austria/EU, mandatory consumer rights, statutory warranty/conformity rights, and update obligations may apply. Nothing in these Terms limits mandatory consumer rights.
If you obtain Adoracle through an app store, app-store terms and cancellation/refund flows may also apply. If Adoracle provides an online withdrawal/cancellation function, it is available at the withdrawal page linked in the footer.
12. Intellectual property
Adoracle, Crystal Sky, Owlzi, app text, quest structures, designs, logos, illustrations, code, prompts, and other materials are protected by intellectual property rights unless marked otherwise. You may use the app for personal, non-commercial purposes under these Terms.
You retain rights in your own photos and notes. If you upload or submit content to Adoracle for verification, support, public sharing, partner reward redemption, or community features, you grant Adoracle the limited rights needed to process, display, verify, transmit, store, moderate, and provide the chosen feature. If public galleries or user-generated quests are introduced, more specific content-license terms should be added before launch.
13. Third-party services
Adoracle may link to or interact with third-party services such as map providers, app stores, AI providers, email providers, social networks, partner businesses, analytics/crash providers, or payment providers. Third-party services have their own terms and privacy practices. Adoracle is not responsible for third-party services outside its control.
14. Availability and changes
Adoracle may be experimental and may change, pause, remove, or add quests, fortunes, rewards, points, features, regions, partner offers, or technical requirements. The service may be unavailable because of maintenance, hosting issues, provider outages, app-store restrictions, legal reasons, safety concerns, or business decisions.
15. Liability
Adoracle does not exclude liability where exclusion would be unlawful, including liability for intent, mandatory statutory liability, or personal injury where applicable. To the maximum extent permitted by law, Adoracle is not liable for indirect losses, lost data where the user failed to keep available backups, unavailable partner offers, unsafe user behavior, unlawful entry, photography disputes, third-party services, or inaccurate AI/location/quest results.
Consumers retain all mandatory rights under applicable Austrian/EU consumer law.
16. Withdrawal, termination, and support
You can stop using Adoracle at any time. If you have an account, you may request deletion. If you entered into a consumer distance contract for a digital service, withdrawal/cancellation rights may apply as explained on the withdrawal page. For free local-only use, deletion of local data and stopping use may be the practical way to end use of the service.
17. Governing law and disputes
These Terms are governed by Austrian law, excluding conflict-of-law rules, unless mandatory consumer protection rules in the user's country provide otherwise. Courts with jurisdiction under applicable law remain competent.
Adoracle does not include an EU ODR platform link because the EU ODR platform has been discontinued. If a consumer dispute cannot be resolved directly, Adoracle will provide information about relevant Austrian alternative dispute resolution bodies where required in the specific case.
18. Changes to these Terms
Adoracle may update these Terms when the service, law, or business model changes. Material changes should be communicated in the app or on the website. Continued use after the effective date means acceptance where legally valid. If you do not accept changes, you should stop using the service and request deletion where applicable.
